The legal context in Canada, in plain terms
This isn’t legal advice, just context worth knowing. Section 162.1 of Canada’s Criminal Code makes it an offence to publish or distribute an intimate image of someone knowing they didn’t consent, or being reckless about whether they did, and also to threaten to. The definition includes a reasonable expectation of privacy, so whether a particular leak fits is for the police or a lawyer to judge.
Age verification is still being debated. Bill S-209, the Protecting Young Persons from Exposure to Pornography Act, would make it an offence for an organization to make pornographic material available to young people online for commercial purposes, with a defence for organizations using a prescribed age-verification or age-estimation method. It passed the Senate on April 15, 2026; according to LEGISinfo, it’s at second reading in the House of Commons, most recently debated on September 24, 2026. It isn’t law.
OnlyFans already checks every creator’s age and identity with an ID document and a selfie. Provinces can add their own routes: in British Columbia, for example, an online tribunal can order intimate images shared without consent to be taken down.
